Boy, 13, sexually abuses girl of same age during school lunch break: police

A 13-year-old boy inserted his finger into the vagina of a girl of the same age against her will in the staircase of a building last month, Judiciary Police (PJ) spokeswoman Lei Hon Nei announced during a regular press conference on Friday.

According to Lei, the schoolgirl first met the schoolboy on a social media app last year, and since then they had met occasionally.

They are enrolled in two different schools in the peninsula’s central district.

On April 22, the two students met in the staircase of a building in the central district during the school lunch break, Lei said.

According to Lei, the schoolgirl brought a bottle of an alcoholic beverage with her, and she and the schoolboy started drinking.

Under the influence of alcohol, Lei said, the schoolboy became sexually aroused, “forcibly” took off the schoolgirl’s clothing, and inserted his finger into her vagina.

According to Lei, the schoolgirl refused the schoolboy’s action, pushed him away from her and ran off.

After the schoolgirl returned to school in the afternoon, she felt unwell and went to hospital for treatment. The case came to light after she told a doctor about the incident. The hospital reported the case to the police.

After receiving the report, the Judiciary Police’s Youth Concern Group contacted the two schools about the case, Lei said.

After being contacted by the police, the schoolboy’s parents took him to the PJ headquarters on Monday last week for questioning, Lei said.

Under questioning by the police, the schoolboy admitted to having inserted his finger into the schoolgirl’s vagina against her will, Lei said.

According to Lei, the Judiciary Police have transferred the case, which has been formally classified as rape, to the Public Prosecutions Office (MP) for further investigation.

Macau’s age of criminal responsibility stands at 16, which means that those younger than that age cannot be charged.

Rape (Article 157 of the Macau Penal Code) refers to forced sex – namely sexual intercourse (vaginal sex), anal sex or oral sex – by means of violence or intimidation – regardless of the victim’s age and gender. According to the article, a person also faces a rape charge if they – by means of violence or intimidation – insert an object, or any particular part of their body, into the victim’s vagina or anus. Rape offenders face a prison term of between 3 and 12 years. They face a prison term extended by one-third of the normal duration if the victim is under the age of 16.
