Man sexually abuses ‘dizzy’ ex-girlfriend: PJ

A 19-year-old local man, surnamed Leong, was arrested for sexually abusing his intoxicated ex-girlfriend at her flat last week, Judiciary Police (PJ) spokesman Choi Ian Fai said during a regular press conference yesterday.

Choi said that the suspect is a student from a local university and the female victim is an 18-year-old local secondary school pupil. Choi said that Leong and the victim used to be in a relationship between 2017 and 2019, but they broke up last January. Choi pointed out that they kept in touch even after the breakup.

According to Choi, the incident happened last Thursday at around 11 p.m. when the suspect went to the female’s flat to work on an assignment and to return the victim’s belongings. Choi said that the victim’s family was away when the incident happened.

Choi said that when the two were working on the assignment, Leong offered the victim a puff of his e-cigarette. After the victim smoked the e-cigarette, she felt dizzy and tired and went into her room to lie on the bed, according to Choi.

According to Choi, the suspect went into the victim’s room and hugged her from behind, then proceeded to touch her private area. Choi said that according to the victim, even though she was intoxicated she still felt that they had sexual intercourse.

The victim said that she resisted and yelled at her ex-boyfriend to stop but the entire incident lasted less than five minutes after which the suspect left the flat, according to Choi.

Choi said that after the suspect had left, the victim went to the bathroom and called a friend about the incident, adding that the victim went to a police station with her friend and reported the case at 5 a.m. on Friday. Choi added that the victim was given a urine drug test which showed that she had not taken any illegal substances.

According to Choi, on Saturday the suspect went to the police and confessed that he did have sexual intercourse with the victim, but claimed that it was not by force. However, Choi said that according to the building’s CCTV, the suspect did not leave from a proper exit but walked down the stairs hence the police found him to be acting suspiciously.

Leong was transferred to the Public Prosecutions Office (MP) on Sunday for further questioning, facing possible arraignment on a charge of sexual abuse of a person incapable of resistance, Choi said.

According to Article 159 of the Penal Code, the offender of sexual abuse of a person incapable of resistance faces a prison term of between one and eight years. If the case involves sexual intercourse, the prison term ranges between two and 10 years, according to the Penal Code.
